PUBLIC HEARING ON MORATORIUM

JULY 16, 2008

 

 Supervisor opened the Public Hearing with the Pledge of Allegiance.  Roll call:  Present Councilman Knapp, Gunn and Mayhew, Supt. Csizsmar and Supervisor Patterson.  Absent Councilman Woolschlager.

 

 

Supervisor opened the hearing to the floor:

 

Ms. Lisa Robinson, representing Ms. Rose Pettit expressed her opinion of the dangers of extracting water and was in favor of the moratorium.  Mr. David Kogut expressed his opinion that water is a community resource; town has no right to control.  Mr. Floyd Rivers indicated that the moratorium issue was introduced in February, 6 months have already passed and it has not been worked on, he also stated that the draft of the Local Law was not in its final form, no enforcement or penalties are stated on the draft.  Mr. Al Fayle stated that there are enough rules and regulations already in place, and no more are needed.  Mr. Jack Hughes spoke and is in favor of the moratorium, stating he would like to see a clean understandable package.  Mrs. Jeannie Kogut expressed that the State already has laws for water extraction that would regulate the Smoke project.  Supervisor Patterson told Mrs. Kogut that the Smoke project was dead and had nothing to do with the Moratorium.  Mrs. Kogut told the Board that the Town has laws no being enforced and does not need new ones.  Mr. Bob Hinman asked the board to please vote yes on the moratorium.  Ms. Joann Mitchell asked if work already in progress would be stopped, she was told that permits already granted would not be involved.  Mr. Al Fayle stated that perhaps if the Moratorium was specified as commercial it would be easier for people to accept.

 

A motion to adjourn the Public Hearing was made by Councilman Mayhew, Seconded by Councilman Knapp, voting no was Councilman Gunn, voting yes was Supervisor Patterson, motion is carried.

 

Public Hearing is adjourned until August 20, 2008 at 5:45 PM.
